Will neopets sue you?

    Hey, I just discovered this in the neopets Terms and Conditions,

    You agree that if you disseminate, design or assist in the design of a third party program that changes the game play on Neopets, you will pay Neopets, Inc. liquidated damages in the sum of Fifty Thousand Dollars for each such program as liquidated damages. You agree that if you use such a program on the neopets.com website, you will pay Neopets, Inc. liquidated damages in the sum of Five Hundred Dollars for each time you use a program.

    What are the chances that they'll sue me?

    :eek: tbh I want neopets to sue me.

    They sue me I lose couple of grand. I talk to papers I earn 10 grand :D

    Hmm. The possibility is there but what actually is the offence? Cheating is not a criminal offence. Breaching terms and conditions could be constrewed as a contractual breach but TNT would have to show a financial loss and as the site is free I doubt they could do that.

    And could you imagine the papers 'Website sues 14 year old' it would bring very bad publicity. Most of us who play Neopets are quite young, students, I don't believe many of us have 50K real money (I barely have 50 pound hah) so if they were to sue no one would be able to pay the damages so it would be an entirely fruitless persuit!

    Thats my legal perspective heh!

    Yes, I believe they were more protecting themselves against programs which would delete their files or send bugs into their system. As we all know, cheating is 'morally wrong' but not legally wrong unless you cheat in a campaign to become president or something.

    I dont think you can even sue a 12 year old? And yes, if they did, bad publicity comes quite quick.

    wtf. if they sued anyone, that would be the end of neopets. someone said cheating is morally wrong, but so is suing a kid. we should be the ones suing them for umm... icing people :)

    true to all above posts...but a while back I was a member of one group that made neopet programs, and that sites sub forum for neopet programs got closed cuzz TNT threatened to sue them! But as individuals, I doubt it

    Haha, good find! I never thought about that, but I assume that they wouldn't go too far in-depth looking for who created these programs. A lot of games have almost the identical terms of use yet they never do anything if these programs exist. It's just to scare you, and if they do go as far as to sue then I would be shocked.

    would it be wise to write them a letter to their corporate asking for one of my account back when i transfered abed np into it, syaing i never did lol?

    I doubt this is true, I mean I am not saying your lying or anything because I read the T+C and yeah it says that/ But it says last updated March 2006. And it pretty much says you AB you get sued. Now, I know tooons of people have been iced for ABing within the last year, me included. If you get iced for ABing and they say u AB you get iced, well, why haven't I been sued? I swear, about 1,000 accounts, probably more, have been iced within the year for using any kind of program. So I wouldn't worry too too much. Haha, someone should like go AB and then sue for false advertising, xP

    You could try it, they would probably ignore you though. We all know how rude TNT are!

    There would also be the issue of proof. How could they trace it back to prove who made it! It's all an empty threat.

    Actually, according to the T+C, they sue just for using the program itself.

    OHHHH...does anyone have a link to the T&C back in 2003? Did they have this clause back then, if not then i think i might be safe.

    the court costs would be too high, tnt wouldnt waste real money on something thats almost guaranteed to fail :p
